Fetch Limited Warranty

By purchasing and/or using our products, you hereby agree to the following terms. If you as the purchaser or user are not prepared to accept these terms, you are advised to return the product immediately to Fetch in new and unused condition.

Product: Fetch Retriever System
Warranty Period: 90 days from the date of purchase (exception: 30 days for batteries)

1. Warranty Coverage
Fetch Labs LLC (“Fetch”) warrants to the original purchaser that this product is free from defects in materials and workmanship at the date of purchase. If a defect appears within the warranty period, Fetch will, at its sole discretion, repair or replace the product at no charge for parts or labor. SERVICE OR REPLACEMENT AS PROVIDED UNDER THIS WARRANTY IS THE PURCHASER’S SOLE AND EXCLUSIVE REMEDY. Fetch reserves the right to inspect any and all product(s) involved in a warranty claim. Proof of purchase is required for all warranty claims. This warranty is non-transferable and only applies to the original purchaser.

2. What is NOT Covered
This warranty does not cover:

  • Damage Due to Misuse or Abuse: Improper operation, negligence, or lack of maintenance.

  • Loss: Loss under any circumstances. This includes without limitation improper operation, negligence, lack of maintenance, loss of power for failure to maintain adequate charge on boat/remote battery, loss of control signal, runaway events, stranding the boat on debris or other obstructions, theft, confiscation for failure to follow applicable laws or regulations, etc.

  • Cosmetic Damage: Scratches, cracks, or dents in the hull or canopy.

  • Water Damage: Damage caused by improper sealing of the electronics compartment and/or pontoons, submerged electronics (including the remote), or operating in conditions beyond the boat's design specs.

  • Modifications: Any changes made to the electronics, motor, or structural components.

  • Consumable Parts: Items that wear out over time, including but not limited to batteries, propellers, drive shafts, and bearings.

  • Fire Due to Improper Battery Practices: Damage caused by failure to strictly adhere to the provided instructions for battery handling, charging, care, and safety.

3. How to Obtain Service
To obtain warranty service, please contact Fetch at [warranty@fetchducks.com] to obtain a Return Authorization (RA) number. The customer is responsible for shipping costs to our service center.

4. DISCLAIMER
OTHER THAN THE EXPRESS WARRANTY ABOVE, HORIZON MAKES NO OTHER WARRANTY OR REPRESENTATION, AND HEREBY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE PURCHASER ACKNOWLEDGES THAT THEY ALONE HAVE DETERMINED THAT THE PRODUCT WILL SUITABLY MEET THE REQUIREMENTS OF THE PURCHASER’S INTENDED USE.

5. SOLE REMEDY
Fetch’s sole obligation and purchaser’s sole and exclusive remedy shall be that Fetch will, at its option, either service or replace any product determined by Fetch to be defective. Fetch reserves the right to inspect any and all product(s) involved in a warranty claim. Service or replacement decisions are at the sole discretion of Fetch. Proof of purchase is required for all warranty claims. SERVICE OR REPLACEMENT AS PROVIDED UNDER THIS WARRANTY IS THE PURCHASER’S SOLE AND EXCLUSIVE REMEDY.

6. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT AVAILABLE UNDER APPLICABLE LAW: (A) FETCH SHALL NOT BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS OR PRODUCTION OR COMMERCIAL LOSS IN ANY WAY, REGARDLESS OF WHETHER SUCH CLAIM IS BASED IN CONTRACT, WARRANTY, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER THEORY OF LIABILITY, EVEN IF FETCH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND (B) IN NO EVENT SHALL FETCH’S LIABILITY EXCEED THE INDIVIDUAL PURCHASE PRICE OF THE PRODCUCT AT ISSUE.
